Worker’s compensation claims in New York State are settled via what they call a Section 32 settlement. Section 32 settlements are when the insurance carrier and the injured worker come to an agreement, typically through each party’s attorneys, to settle and close out the indemnity or the wage replacement benefits, and most of the time, the medical portion of the claim as well.
